Draft regulation for the sale of goods of Euro Tyres
Business Recovery BD&A SPRL, as judicial liquidator of the debtor Euro Tyres Manufacturing SRL, according to Interim Decision no. 398 of 31.01.2025 pronounced by the Bucharest Court, 7th Civil Section in file no. 14239/3/2018,
taking into account the decision of the Creditors' Meeting adopted at the meeting on 24.12.2024, approving the measure to capitalize the assets held by the debtor Euro Tyres Manufacturing SRL, at a minimum value of 35,000,000 USD, plus VAT if applicable according to national legislation, taking into account the initial offer received, as well as the approval of the Sales Regulation related to the proposed measure, taking into account the decision of the Creditors' Meeting adopted at the meeting on 20.02.2025, approving the amendment to the proposed Sales Regulation, namely the extension of the deadlines for completing the stages of the sale established by the regulation, taking into account the opening of the bankruptcy procedure on 31.01.2025 and the completion by the judicial liquidator of the inventory of the debtor's assets, taking into account the existence of the valuation report on file of the assets, which according to the evaluator's specifications is current (it was drafted on 16.05.2024) and can be used appropriately in the bankruptcy procedure, taking into account the purpose of the bankruptcy procedure, namely the liquidation of the assets and the payment of creditors' claims, as well as the principles that define the bankruptcy procedure regulated by Law no. 85/2014, namely the principle of timely and efficient valorization of assets, as well as the principle of expeditious execution of specific acts and operations,
pursuant to art. 47 in conjunction with art. 63, art. 57 and art. 154 et seq. of Law no. 85/2014 on insolvency prevention and insolvency procedures,
CONVENES THE MEETING OF CREDITORS OF THE DEBTOR

The meeting of creditors will take place at str. General H. M. Berthelot no. 84, ground floor, space B, Sector 1, Bucharest, on 14.02.2025, 10.30 a.m., in order to approve the sales regulations.
